Jacquelyn Smith Clarke is an Associate in our Atlanta office. She earned her Juris Doctorate from the Walter F. George School of Law, where she graduated in the top 10% of her class. In law school, she was a member of the Mercer Law Review, the Journal of Southern Legal History, and the Mercer Advocacy Council. She competed in two national moot court competitions where she gained valuable experience as an oral advocate and brief captain. She also coordinated the student mentor program at Mercer and received the Dean’s Award for Distinguished Service to the Law School. Ms. Clarke is also published in the Mercer Law Review.
Ms. Clarke attended Berry College for her undergraduate studies, where she earned a Bachelor of Science Degree in Government and Philosophy, magna cum laude. During her undergraduate career, she also served as a research assistant. Through the Bonner Scholar Program, she was very involved in community service. In addition, Ms. Clarke served as captain for the women's cross country team. She spent her summers with the Georgia Innocence Project, where she received the Equal Justice Works Education Award for public service.
Since joining the firm, Ms. Clarke’s practice has involved the defense of a wide variety of complex and catastrophic matters that include products liability, boat design, admiralty, trucking, professional negligence (accountants, physicians, attorneys, and engineers), premises liability, adverse actions in bankruptcy, civil rights / section 1983 matters, aviation, and construction. Ms. Clarke is a skilled trial attorney with a great deal of success in the courtroom. She has gained significant experience throughout the country on the National Trial Counsel team very early in her career. Her experience far exceeds that of her peers. Ms. Clarke has “stand up” experience in court involving jury trials with eight figure demands. On behalf of corporations throughout the U.S., she has conducted direct and cross examinations of both fact and expert witnesses in the defense of high exposure jury trials. Ms. Clarke has appeared as trial counsel in matters located in Alabama, Arkansas, California, Florida, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, Oklahoma, and throughout Georgia. A significant part of her practice includes short notice appearance in matters already scheduled for trial. In these matters, she is primarily responsible for overseeing the transition of the case from previous or local counsel and preparation of the trial team. In Georgia, Ms. Clarke has served as lead and co-counsel. On a day-to-day basis, she oversees the management of legal staff and attorneys to conduct pre-suit investigations and discovery for matters not yet scheduled for trial. Ms. Clarke also has experience managing voluminous E-Discovery productions.
Ms. Clarke represents professionals, including attorneys, engineers, physicians, and accountants against claims of malpractice, breach of fiduciary duty, or ethical violations. Ms. Clarke has represented professionals in litigation pending in local courts as well as federal court.
