Jacquelyn Smith Clarke is an Associate in our Atlanta office. She earned her Juris Doctorate from the Walter F. George School of Law, where she graduated in the top 10% of her class. In law school, she was a member of the Mercer Law Review, the Journal of Southern Legal History, and the Mercer Advocacy Council. She competed in two national moot court competitions where she gained valuable experience as an oral advocate and brief captain. She also coordinated the student mentor program at Mercer and received the Dean’s Award for Distinguished Service to the Law School. Ms. Clarke is also published in the Mercer Law Review.
Ms. Clarke attended Berry College for her undergraduate studies, where she earned a Bachelor of Science Degree in Government and Philosophy, magna cum laude. During her undergraduate career, she also served as a research assistant. Through the Bonner Scholar Program, she was very involved in community service. In addition, Ms. Clarke served as captain for the women's cross country team. She spent her summers with the Georgia Innocence Project, where she received the Equal Justice Works Education Award for public service.
Since joining the firm, Ms. Clarke’s practice has involved the defense of a wide variety of complex and catastrophic matters that include products liability, boat design, admiralty, trucking, professional negligence (accountants, physicians, attorneys, and engineers), premises liability, adverse actions in bankruptcy, civil rights / section 1983 matters, aviation, and construction. Ms. Clarke is a skilled trial attorney with a great deal of success in the courtroom. She has gained significant experience throughout the country on the National Trial Counsel team very early in her career.  Her experience far exceeds that of her peers. Ms. Clarke has “stand up” experience in court involving jury trials with eight figure demands. On behalf of corporations throughout the U.S., she has conducted direct and cross examinations of both fact and expert witnesses in the defense of high exposure jury trials. Ms. Clarke has appeared as trial counsel in matters located in Alabama, Arkansas, California, Florida, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, Oklahoma, and throughout Georgia. A significant part of her practice includes short notice appearance in matters already scheduled for trial. In these matters, she is primarily responsible for overseeing the transition of the case from previous or local counsel and preparation of the trial team. In Georgia, Ms. Clarke has served as lead and co-counsel. On a day-to-day basis, she oversees the management of legal staff and attorneys to conduct pre-suit investigations and discovery for matters not yet scheduled for trial. Ms. Clarke also has experience managing voluminous E-Discovery productions.

Practice Areas


Ms. Clarke has experience representing contractors, subcontractors, developers, and insurance companies in various construction design and defect, delay, contract compliance, insurance coverage, personal injury, and property damage matters. Her practice is focused on the litigation of construction cases, including mediation and trials in both state and federal courts throughout Georgia.
Ms. Clarke has experience representing design professionals in a wide range of litigated matters arising from the design and construction process. She has experience defending claims arising from Americans with Disabilities Act compliance, breaches of contract, construction defects, construction delays, professional negligence, and worker injuries/bodily injuries.


Ms. Clarke has defended dentist and medical professionals in several civil suits and represented dentist in administrative hearings.

General Liability

Jacque brings experience in a wide variety of general liability claims, specifically premise liability. She has trial experience in both state and federal courts, handling cases of all levels of exposure, and involving a wide array of allegations and issues including defending premises liability claims, negligent security claims, motor vehicle accidents, and personal injury claims.  She represents property owners, businesses, and facilities in claims involving anything from minor injuries to wrongful death.  She supports clients through all stages of litigation, from notice of a claim through final resolution.

Insurance Coverage

Ms. Clarke has extensive experience in providing insurance coverage opinions regarding life, property, and casualty coverage issues including CGL policies, bad faith, uninsured motorists, causation, and excess coverage under commercial and personal policies.

Products Liability

Ms. Clarke has experience representing manufacturers in the defense of products liability claims resulting from injuries or death, alleged to be caused by product defects.  She is prepared to assist manufacturers and suppliers in the investigation and defense of products liability actions. She has managed large scale electronic discovery requests directed at international product manufacturers and defended proprietary interests related to products at issue in litigation.

Professional Malpractice and Ethics

Ms. Clarke represents professionals, including attorneys, engineers, physicians, and accountants against claims of malpractice, breach of fiduciary duty, or ethical violations. Ms. Clarke has represented professionals in litigation pending in local courts as well as federal court.

Professional Negligence / Medical Malpractice

Ms. Clarke defends medical professionals and medical facilities, including doctors, nurses, and hospitals, against claims ranging from negligent treatment and diagnosis to birth trauma and wrongful death.  She handles cases from inception through investigation and all aspects of litigation.  Ms. Clarke also represents medical professionals in matters before the respective licensing boards and has handled peer review proceedings before hospital panels of physicians.


Ms. Clarke is experienced in handling litigation and resolving cases involving many aspects of the transportation industry. She has represented insurers and carriers within the industry in litigation pending in local courts as well as federal court. She has the experience and qualifications to respond to incidents within hours.  Ms. Clarke has represented defendants in auto accidents, including both passenger vehicles and tractor-trailer accidents ranging from minor injury accidents to multiple fatality accidents.
