Ryan M. Donihue is a Partner in the HBS Atlanta and Asheville offices.
Mr. Donihue received a Bachelor of Arts degree from the University of Puget Sound in 1997. He earned his Juris Doctor from New York Law School in 2000. He is admitted to practice in North Carolina, Georgia, Texas, New York and Connecticut.
Before joining the firm, Mr. Donihue was a Partner with Martin Clearwater & Bell, LLP, which was the oldest medical malpractice defense and health-care firm in New York state. He focuses his practice on the defense of hospitals, physicians and nurses in birth trauma, catastrophic injury and complex malpractice actions. He is also the co-leader of the Dental Practice Group at HBS.
Mr. Donihue also represents dentists and other dental providers, podiatrists, psychologists and other health-care professionals in medical malpractice cases and related issues. He has extensive experience representing health-care professionals in disciplinary proceedings. Mr. Donihue lectures throughout the country on the defense of complex medical and dental malpractice actions to professionals, health-care institutions and insurance companies.
Prior to entering private practice, Mr. Donihue was an Assistant Corporation Counsel with the New York City Law Department, in the Medical Malpractice Unit of the Office of the Corporation Counsel where he represented hospitals and healthcare providers in New York state.
Mr. Donihue is a co-leader of the Dental Practice Group at HBS. He specializes representing and defending oral and maxillofacial surgeons, periodontists, orthodontists, endodontists, general dentists, pediatric dentists, hygienists, and their practices and staff members in malpractice actions. He also represents dentists at professional licensing matters before the State Board.
He has also published numerous articles and lectured on developing trends in dental malpractice, and proactive steps to take in order to avoid professional discipline by the State Board.
Mr. Donihue focuses his practice on the defense of hospitals, physicians, midwives, nurses and institutional employees in birth trauma and catastrophic injury cases. He also represents and defends health-care institutions, private practices, physicians, psychologists, nurses, physician assistants, medical students and medical practice staff members in complex medical malpractice actions from inception through trial. Mr. Donihue has extensive experience representing health-care professionals before State Boards in licensing and disciplinary matters. Finally, he has lectured at hospital grand rounds, discussing the increasing trends in malpractice actions, state investigations and professional discipline cases.
Psychiatry, Psychology and Mental Health
Mr. Donihue has extensive experience representing psychiatrists, psychologists and mental health providers in complex malpractice actions and disciplinary actions. Defense in the field of psychiatry, psychology and mental health matters requires a significant decree of expertise which Mr. Donihue has continually demonstrated from pre-suit investigations through trial. Additionally, Mr. Donihue has successfully represented various psychiatrists, psychologists, nursing staff and mental health providers before state disciplinary boards.
Opioid Defense Task Force
Mr. Donihue is a member of the HBS Opioid Defense Task Force. He has extensive experience in the defense of healthcare providers, practices and institutions in county, state and federal investigations pertaining to the prescription and administration of opioids and other related drugs to patients. Mr. Donihue has successful represented numerous healthcare providers in malpractice actions involving drug/opioid prescriptions; patient monitoring of drugs/opioids; allegations surrounding overdosing, and drug interaction. He has also represented a significant amount of healthcare, dental and mental health providers before state disciplinary boards as it related to opioid and classified prescription drugs.
Mr. Donihue has extensive experience representing podiatrists in malpractice actions. With the increasing trend of malpractice suits against podiatrists and their practices, Mr. Donihue successfully defends podiatrists and their practices from the inception of the lawsuits through trial. Additionally, he often counsels podiatrists on ways to take affirmative steps in their practices to avoid potential malpractice actions and investigations of the State Board.
