Aside from emergency medical treatment that may be required for a worker injured on the job, states in the southeast (SC, NC, AL, TN, FL, GA, MS and LA) have different rules regarding the initial authorized medical treatment for injured workers. For employers who operate in multiple states, and for insurance adjusters with claims in multiple states, knowing what to do to authorize this initial medical treatment can be critical to appropriately manage and reduce costs for new claims from the onset Our review will start with the most employer friendly states and will end with the least employer friendly state in the southeast in terms of initial authorized medical treatment: In South Carolina, the employer selects the physician. In North Carolina, the employer makes the initial selection of physician, but the employee can choose a physician of his own, but only if the employee obtains the approval of the…       Read More

Earlier this month I published a Post on, “The Importance of Cyber Security in Telemedicine”, highlighting the importance of security for medical devices that can be hacked. Almost as if on cue, or more likely the result of lucky timing, on May 21, 2015, the IEEE Cybersecurity Initiative ( published, “Building Code for Medical Device Software Security”, authored by Tom Haigh and Carl Landwehr. The paper is the result of a two-day workshop in November 2014, attended by 40 volunteers from the fields of cyber security, computer programming, and medical devices, among others. The workshop was sponsored by the IEEE Cybersecurity Initiative and the National Science Foundation. Recognizing that medical devices are vulnerable to malicious attacks that can alter the operation of a device, or steal sensitive data, the building code is intended to reduce the risk of such attacks. While the code cannot protect medical devices against every imaginable…       Read More

Communication is one of the most important aspects of a well-managed, successful workers’ compensation program. It is extremely important to establish good relationships with supervisors, employees, and medical providers both prior to and after a work injury occurs. Injured employees usually are not knowledgeable about the workers’ compensation system and experience fear, doubt, and worry about the status of their job. Immediate contact with the injured employee will help alleviate these fears and will establish trust. The following information provides guidelines for effective communication among employers, physicians, other medical providers, attorneys, and the State Board. These guidelines are intended to build a partnership associated with a workers’ compensation claim. Telemedicine is coming to a hospital or medical office near you. What is telemedicine? Simply put, telemedicine is when the medical provider is in one location and the patient is in another. The medical professional uses telecommunication technology, often times via the internet, to provide medical care to the patient. Unfortunately, any time information travels across the internet, no conversation is complete without considering the security of the technology. I just read an article about the use of a telerobot, allowing a physician to operate from a remote location using a robot at the patient’s bedside ( The article highlighted how a hacking team from the University of Washington Department of Electrical Engineering and of Computer Science and Engineering found that they could hack into the robot’s computer systems and take control of the teleoperation. They could tell the robot to ignore, or change directions of the surgeon, or cause…       Read More
