Overview
Shawn Pinkston is an associate in the Charleston office of Hall Booth Smith. He joined the firm after serving in the United States Army Judge Advocate General's Corps while he was stationed at Fort Stewart, Georgia.
Mr. Pinkston is a decorated veteran of the Iraq War. He deployed with the Third Infantry Division where he established and led the Military Justice Office. As a military lawyer, Mr. Pinkston served as Chief of Legal Assistance and was the lead prosecutor for one of the busiest jurisdictions in the US Army.
Prior to attending law school, Mr. Pinkston worked for elected officials at both the state and national level. Mr. Pinkston served as Communications Director for the Kentucky Senate President and held the same position for the Honorable Ron Lewis, United States Representative.
Mr. Pinkston is a graduate of the Saint Louis University School of Law. While in college, he participated in the National Moot Court Competition and the National Trial Advocacy Competition. He was a member of the Saint Louis University Public Interest Law Review and was listed in the 24th edition of Who’s Who: American Law Students.
Mr. Pinkston earned his undergraduate degree from Berea College, located in Berea, Kentucky, where played varsity soccer and was named an Academic All-American in 1996.
Practice Areas
General Liability
Mr. Pinkston has significant experience in litigating many different types of civil litigation, including numerous general liability claims. He has represented apartment owners, hospitals, and homeowners in many different types of premises liability actions where injuries ranged from the soft tissue injury to the more significant cases of rape, physical assault, and death.
Professional Negligence / Medical Malpractice
Mr. Pinkston represents doctors, hospitals, and other health care providers against claims of malpractice and negligence. He advises and prepares both clients and experts for all stages of litigation. Mr. Pinkston has defended medical professionals and hospitals against allegations of negligence, premises liability, wrongful death, and agency/employment relationships.
Long Term Care and Senior Housing Industry
Mr. Pinkston dedicates a significant portion of his practice to defending skilled nursing facilities and assisted living facilities. He has represented care providers in lawsuits ranging from the development of pressure sores, abuse and neglect, wrongful death, and failure to comply with South Carolina Regulation 61-84. As part of his practice, Mr. Pinkston has advised directors of senior housing facilities on compliance with South Carolina Regulation 61-84.
Construction
Mr. Pinkston has represented a wide-range of clients associated with the construction industry. He has defended general contractors, subcontractors, and home inspectors in cases ranging from construction defect, personal injury, negligence, and breach of contract throughout the state of South Carolina.
